Imagine this: Michael Jackson's Will states his father is not to get anything from Michael's Estate right? Do you think Michael would be rolling over in his grave if he found out his father could receive Katherine Jackson's 40% inheritance from her son?

We set out to address questions you have asked time and time again. How can Joe Jackson get his sons money even though he was disinherited from his will? But didn't Michael have a Trust distribution clause in his Will? If so, how does a litigant like Mrs. Jackson get around the legal wrangling?

"The big issue is whether or not Katherine Jackson's 40% inheritance from Michael is asset protected. We see this with many family's that don't want to see their hard earned assets go to an evil in-law or the greedy government. This is why we have Trusts in place. But there is one bright example of why Michael's may fail and his father could receive Katherine's share." States Joseph J. Dadich, attorney and probate litigator from his West Bloomfield office in Michigan.

He reiterated a few key points for our readers/listeners, "Here is what could happen. Katherine Jackson at age 79 could pass away. And since she is married to Joe Jackson he would be entitled to her estate – unless she has a Will or Trust stating otherwise. Which seems contrary to Michael's intentions. However, once Katherine passes on her estate would be entitled to the 40% share stated in his Will and presumably in the Trust also."

This is shocking to hear that Joe Jackson – who has been vilified on shows like Larry King to Nancy Grace and Bill O'Reilly are all still talking about Michael Jackson Will - for having allegedly raised Jackson with a couple belt lashes.

"This is a tricky situation and the attorney representing a beneficiary like this needs to be prepared. They will be attacked and to support their claims here's a little-known secret. Now we don't know if Katherine Jacckson has a will or trust to change her distribution patters. But she may not have created any emergency estate planning documents."
